Recent court filings show that 3M has settled its third lawsuit involving alleged infections linked to the Bair Hugger™ Forced-air Warming device.
The case, Douglas Tye v. 3M (1916-CV00825), was settled on June 17, 2025, according to records from a Minneapolis federal court.
Two other cases were previously settled with similarly confidential terms:
- Joyce Boncher (E.D. Penn., 5:24-cv-01403) – Patient required multiple surgeries and continues to experience persistent pain.
- John Petitta (Hidalgo County, TX, C-5130-16-A) – Patient contracted a MRSA infection. Must take lifelong antibiotics and faces the risk of amputation.

Punitive Damages Claim Moves Forward in Florida
In a related case — Tina Robinson v. 3M (M.D. Fla., 8:24-cv-00828-WFJ-AAS) — the court denied 3M’s motion for summary judgment, allowing punitive-damage claims to proceed.
The court stated:
“[A] reasonable jury could find Defendant acted with reckless indifference to the safety of patients.”
That finding cites Neurospine (2023;20(4):1328-1336), which reviewed 5,406 posterior lumbar fusion surgeries and concluded that patients treated with Forced-air devices were more likely to develop surgical-site infections than those warmed with air-free conductive systems.
